These Terms set forth the conditions for use of the cross-border HR platform "OwlMatch" (the "Service") provided by TSUNAGU Co., Ltd. (the "Company"), between all users (the "User") and the Company. The User shall apply for registration in accordance with the method prescribed by the Company after agreeing to these Terms. The Company may refuse registration if it determines that the applicant falls under any of the following: 1. Has provided false information in the application 2. Has previously been subject to suspension for violation of these Terms 3. Other cases where the Company deems registration inappropriate
The Company shall handle personal information acquired in providing the Service appropriately in accordance with a separately established Privacy Policy. Cross-border data transfers shall comply with the personal information protection laws of China, Japan, and other countries (PIPL / GDPR / APPI, etc.).
When using the Service, the User shall not engage in any of the following acts: 1. Acts that violate laws or public order and morals 2. Acts related to criminal activities 3. Acts that infringe upon the rights or interests of the Company, other Users, or third parties 4. Registering or sending false information 5. Unauthorized access, interference with systems, or other acts that hinder the operation of the Service 6. Other acts deemed inappropriate by the Company
The Company may, without prior notice to the User, suspend or interrupt all or part of the provision of the Service in the following cases: 1. When conducting system maintenance, inspection, or updates 2. When provision becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters 3. Other cases where the Company deems suspension or interruption necessary
If a User violates these Terms, the Company may, without prior notice, restrict the use of the Service by the User or terminate the registration. The Company shall not be liable for any damages incurred by the User as a result.
The Company does not warrant, expressly or impliedly, that the Service is free from defects in fact or in law. Employment contracts or service agreements concluded between candidates and companies matched through the Service are entered into between the parties, and the Company shall not be liable for the performance or outcome of such contracts.
The Company may amend these Terms at any time when deemed necessary. Amended Terms shall take effect from the time they are posted on the Service. The interpretation of these Terms shall be governed by the laws of Japan, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute arising between the Company and the User in connection with the Service.
